Terms of Service
Effective August 1, 2026
Agreement and business use
These terms govern access to Cinder Spur for Detailers, business-management software provided by Cinder Spur Systems LLC. By purchasing, creating an account, or using the service on behalf of a business, the account owner confirms authority to bind that business to these terms. The service is intended for business use by adults and is not directed to consumers or children.
Subscription and included capacity
The subscription is $65 USD per month and provides the complete current product for one business location, up to 25 team records, and 25 GB of job-photo storage. The subscription is limited, revocable, non-exclusive, non-transferable, and may not be resold or shared between unrelated businesses.
Optional add-ons
Additional locations, storage, SMS, AI usage, white-labeling, or premium support are not included unless expressly stated. Cinder Spur will not impose an add-on or usage overage charge without first disclosing the price and obtaining the account owner's affirmative agreement. Availability of an add-on is not promised until Cinder Spur offers it in writing.
Automatic renewal and cancellation
The subscription renews monthly at $65 plus applicable taxes until canceled. The renewal terms and total price are shown again before purchase. The account owner may cancel at any time through the billing method made available by Cinder Spur or by contacting support. Cancellation takes effect at the end of the current paid billing period, and no further renewal will be charged after a timely cancellation. Access ordinarily continues through that paid period.
Payment, taxes, and failed charges
The account owner authorizes the payment processor to charge the selected payment method for each renewal. The account owner is responsible for applicable taxes and accurate billing information. Cinder Spur may limit or suspend access after a failed payment, chargeback, fraud concern, legal requirement, or material breach, with reasonable notice when circumstances permit.
Owner responsibility
The account owner is responsible for entered data, customer communications, prices, taxes, refunds offered by the detailing business, legal compliance, user access, backups appropriate to the business, and operational decisions. AI-assisted or automated content is draft decision support and must be reviewed before use.
Activation and account security
Purchases may require identity and payment verification before a private workspace is activated. The account owner must protect sign-in access, grant the least access each worker needs, promptly remove departed users, and notify Cinder Spur of suspected unauthorized access. A purchase does not authorize access to another business workspace or bypass server-enforced role, license, or capacity controls.
Customer data
As between Cinder Spur and the account owner, the account owner retains rights in business records entered into the service. The owner grants Cinder Spur and its service providers permission to host, process, transmit, back up, and secure those records only as reasonably needed to provide, protect, support, and comply with law for the service. Export and deletion options are described in the Data Retention & Deletion notice.
Acceptable use
The service may not be used for unlawful activity, unauthorized access, harassment, deceptive records, malicious uploads, intellectual-property infringement, resale of account access, security testing without written authorization, or attempts to disrupt or reverse engineer the service except where applicable law expressly permits it.
Service changes and availability
Cinder Spur provides the service on a best-effort basis and does not guarantee uninterrupted or error-free availability. Features may be improved, replaced, or retired when reasonably necessary, while Cinder Spur aims to preserve the core paid functionality or provide reasonable notice of a material reduction. Maintenance, emergencies, third-party outages, and events outside Cinder Spur's reasonable control may interrupt access.
Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or specific business results. Cinder Spur for Detailers supports business operations but does not provide legal, accounting, tax, insurance, safety, or financial advice.
Limitation of liability
To the maximum extent permitted by law, Cinder Spur is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profit, lost revenue, loss of goodwill, or loss of data arising from the service. Cinder Spur's total liability for claims relating to the service is limited to the amount paid for the service during the twelve months before the event giving rise to the claim. These limits do not apply where applicable law does not permit them.
Indemnity
To the extent permitted by law, the account owner and subscribing business will defend and indemnify Cinder Spur against third-party claims arising from their unlawful use of the service, customer communications, content, business practices, violation of another person's rights, or material breach of these terms.
Termination and export
The account owner may stop using the service and cancel the subscription. Cinder Spur may suspend or terminate access for material breach, nonpayment, security risk, abuse, or legal necessity. Before access ends, the owner should download needed exports and photos. Provisions concerning payment obligations, ownership, disclaimers, liability, indemnity, and dispute resolution survive termination where applicable.
Governing law and disputes
These terms are governed by the laws of the State of Alaska, without regard to conflict-of-law principles. Unless applicable law requires otherwise, the state and federal courts serving Alaska have exclusive jurisdiction over disputes relating to the service. Before filing a claim, each party agrees to send written notice and make a good-faith effort to resolve the dispute informally for 30 days.
Changes and contact
Cinder Spur may update these terms prospectively. Material changes will be communicated through the service, website, or account email before they take effect when required. Continued use after the effective date constitutes acceptance where permitted by law. Questions or legal notices may be sent to support@cinderspur.com.
